Mice and Men Belonging Extract Essay
The idea of belonging in the novel ââ¬ËOf Mice and Menââ¬â¢ by John Steinbeck, relates to the theory of ââ¬Ëattachmentââ¬â¢ in psychology. For most human beings, having a central place they can return to, ideally with loved ones or supportive friends present also, contributes towards their feelings of calm, relaxation and security. Such a place would ideally be one which provides safety, shelter, food, warmth, affection and earning capacity. Not all those elements are always present ââ¬â sometimes it is enough to live in an RV or trailer park, as long as family or the other things are present. Some nomadic people are happy to pack up and take most things with them ââ¬â as long as they have support they are happy. However, George and Lennie only have each other and sometimes thatââ¬â¢s even a liability ââ¬â whatever ââ¬Ëattachmentsââ¬â¢ they had in youth are gone and that leaves them adrift in a hostile, unpredictable world. That is why they yearn for ââ¬Ëcentrednessââ¬â¢ or the security of a place of their own. The answer to this question lies in the character named Candy in ââ¬Å"Of Mice and Men. An old, disabled ranch hand who is unable to stop the killing of his old friend and dog, Candy realizes that he soon will outlive his usefulness and, perhaps, go the way of his old dog. But, when he hears of Lennie and Georgeââ¬â¢s dream of owning a ranch and a house, he is sweetly hopeful, offering his savings to the men. For, with part ownership, he would not fear isolation and poverty, or abandonment. From owning land, too, there is a sense of pride. The itinerant men of the Great Depression belong nowhere, they had nothing and lived in fear of losing a job, for they could not survive without any money. There is a constant stress put on these men who must few the next man as a threat to his job or security. But, if one has a place of his own, he must answer to no one else. In the early part of the novel, George explains the position of these men in the world: ââ¬ËGuys like us, that work on ranches, are the loneliest guys in the world. They got no family. They donââ¬â¢t belong no place, They come to a ranch anââ¬â¢ work up a stake and then they go into town and blow their stake, and the first thing you know theyââ¬â¢re pounding their tail so some other ranch. They ainââ¬â¢t got nothing to look ahead to. ââ¬Ë I would think that one of the most powerful lessons of Steinbeckââ¬â¢s work is the idea that individuals have to possess a sense of belonging. Part of this is definitely physical. When individuals have to wander from life to life, different form of physicality to different form of physicality, their ability to better understand themselves and others becomes impacted. There has to be some notion of grounding at some point and level where individuals can feel comfortable enough to call it ââ¬Å"homeâ⬠or know that this is where I belong. Despite lacking this, Lenny and George do a fairly good job of providing the belonging to one another. Certainly, Lenny sees George as essential to his conception of belonging. Yet, George does envision Lenny as a part of his own conception of belonging, a vision that appears in Georgeââ¬â¢s dreams and whose faintest touch can be felt in the relationship they both share.
Problem of Good and Evil Essay
? 12/2/09 How can a God who is both omnipotent and good allow evil in the world? For Christians, evil can be a problem because non-believers can use it as a way to attack Christianity. The first thing they might say is if there is evil, then God must not be good or omnipotent because he is allowing it. Yes, God allows evil in the world, but evil does not come from God. Evil comes directly from Satan. We see this in the book of Matthew, vs. 1-11, where Satan tries to tempt Jesus. Another way an non-believer may discredit Christianity is saying that because there is evil, God doesnââ¬â¢t exist. This is definitely false. God does exist and we know because the Bible says so. We also can see the results of his power. Some examples of that are when Moses led the Israelites out of slavery in Egypt and God parted the waters of the red sea so they could get through, but he closed them over the Egyptians and they were wiped out. Another example is the woman who had been bleeding for twelve years, in Mark 5: 25-34, and with one touch of Jesusââ¬â¢ robe, was healed. This is just a little taste of Godââ¬â¢s power over evil. Finally, non-believers could say that God is no better than pagan gods, but he is real and here to save us. God hates evil, but Adam sinned which caused evil in mankind, and he had to bear the consequences of his disobedience against God. The Bible shows us that God is both omnipotent and good. God is omnipotent which means all-powerful. In Luke 1:37, it says ââ¬Å"For nothing is impossible with God. â⬠There isnââ¬â¢t anything that God canââ¬â¢t do. Also in Rev. 19:6, it states ââ¬Å"Then I heard what sounded like a great multitude, like the roar of rushing waters and like loud peals of thunder, shouting: ââ¬ËHallelujah! For our Lord God Omnipotent reignsââ¬â¢. In that verse, we see God directly described using that word. Now on the other hand, God is good. How can we define good? That is difficult to do. My definition of good is: ââ¬Å"Having desirable or positive qualities. â⬠God is good to his people, and everything he has created. Psalm 136:1, a passage about Godââ¬â¢s goodness, says, ââ¬Å"Give thanks to the Lord, for he is good. His love endures forever. â⬠Another passage is from Psalm 34:8, which says ââ¬Å"O taste and see that the Lord is good: blessed is the man that trusts in him. â⬠This verse is saying that if you let God in your life, you will see that he can provide only good things for you. He will not bring evil your way. God may cause trials in your life, but that is only because he wants to produce perseverance, as said in James 1:3.

Others refer to non-core operations, such as property holding. 2. 0 Types of contemporary information systems in Public Bank 2. 1 Customer Relationship Management System Introduction Customer Relationship Management System or usually known as CRM is one of the system used in Pubic Bank Berhad. CRM is a type of software application which used organized customer demographic, account and transactional information to obtain a better understanding of customerââ¬â¢s banking and financing needs, relationships and financial behavior..CRM helps improve the quality of customer relationships and offers opportunities to e xtend and cement the customerââ¬â¢s relationship with the Public Bank Group and improve on the companyââ¬â¢s customer cross-selling ratio. Hardware and Software requirements To install the CRM system, there are some requirements need to be fulfill before proceed to the installment of the system. Of course beside of the basic hardware requirement such as mouse, keyboard, and monitor, it still need some more powerful hardware tools.First and the most important it should has a processor which is at least more than dual 1. 8 GHz Pentium Xeon to keep the server is usable. Using a lower-grade of processor with CRM system will caused server to freeze. Then, it should has a Random Access Memory (RAM) with at least 1 GB which gives its CRM program enough extra headroom to operate on its most basic level. For a better stability, run CRM on a system with 2 GB of memory or more. For the disk space requirement, it should have 400MB or more free space on the hard disk before installing CRM. Last one is the operating system and IIS.CRM need Windows Server 2003 SP2 or Windows Server 2008 in order to operate the CRM system. Along with operating system, Internet Information Services(IIS) version 6. 0 or 7. 0 need to be installed. While for software requirement, first it need a network interface card(NIC) to allows a client computer to connect to the central location where the CRM applications is located. Besides that, it need network protocol to allow two or more computers to communicate. The most common protocol is TCP/IP protocol which is also used to connect to the Internet. Functions and Core activities performedThere are several functions of CRM in Public Bank Berhad which may deal with every different department in the company. 1. Significance -CRM should serve as the method used by Public Bank to gain insight into their existing and future customer base. It allows them to measure the amount of customer business that already exists along with the product and service s that need to be offered in order to retain customers. 2. Function -The function contained within the CRM system must allow Public Bank to formulate its overall marketing and business strategy plan. This function is based upon calculations performed by the CRM platform that produces profitability by asset and liability type followed by the complete drill down to all basic components such as profitability from deposits and loans. 3. Features -CRM platform should be available to all marketing staff, management and any other sales related area of Public Bank. The monitor screens for these staff members should indicate customers by bank officer, business transactions, total and itemized profitability, contact information and customer profile data.It should also provide ââ¬Å"what-ifâ⬠scenarios that allow marketing staff the opportunity to develop personalized business plans for each customer. 4. Considerations -The CRM system of Public Bank must be constantly monitored for proper coding, subiness types; income and cost allocations along with rate analysis. CRM system must be updated and changed for the inclusion of a new business line along with all the associated information necessary for functionality. Advantages and Disadvantages There are a lot of advantages of using CRM in banking industry such as Public Bank Berhad.By using CRM, Public Bank can increase their revenue and profitability where bankers can easily see what products is currently used by customers, what products they are eligible for and what additional benefits should be added into the product or service. Besides, it also can improved customer service when CRM give proactive banks access to technology that helped them improve customer retention by using customer feedback to offer conveniences like ATMs and online banking. Next is the highly target marketing. With the captured data from their customer profile and ransactions, bankers are able to better identify target markets or rank custome rs according to lifetime expected value and then tailor the promotional campaigns to individuals. However, disadvantages of CRM will occurred on the same time. CRM is not always profitable so that Public Bank will need to pay a high cost for the continual maintenance or setup of its server which will takes up company resources. In addition, Public Bank need to hire professionals to train their employees in group in order to provide training for their employees. This may takes away time for productivity because most CRMs have specialized functions for managers and executives. Besides that, implementation of CRM may face overhead problem where Public Bank need to pay an amount of money to the software developers whenever a new version of software was applied to their CRM. Lastly is the integration problem faced by CRM because if a certain CRM system is not compatible with Public Bankââ¬â¢s other system such as email or accounting systems, the CRM system will not be effective. Implem entation ChallengesPublic Bank Berhad should consider of lease the CRM system from outside vendors as it may keep their database organized and updated. Customers trend keeps changing from time to time so they may not captured the trends if their CRM systems is not updated with the latest software or facilities and worse it may lead to lose to compete in the market where many of their customers start on choosing other company. 1. One of the biggest challenges facing by Public Bank to implement CRM is the cost associated with purchasing, installing and training employees to use new software. However, properly implemented of CRM will eventually show a good return on performance of the bank. 2. CRM-centric businesses focus on placing customers and their satisfaction before Public Bank and it is typically very complex and span multiple departments. This means that most employees must go through some sort of training to adopt with the system. 3. In-House CRM software will be more effective than supported system CRM but In-House CRM will be much more difficult to implement.Public Bank should consider supported system which means outsourced to another company in order to help them implement CRM effectively. Supported systems typically less costly to implement because it is not as effective as In-House solutions. Security Issues Possible security attacks in a CRM system are: 1. Denial of service (DOS) is a type of attacked in system where it attacked the system and make it unavailable to customers. Some of the possible attackers are angry customers, script kiddies, formal employees, and the competitors. 2.Intrusion of sales automation systems and customer database. Sales Automation systems normally have numerous information about customer so it may effort risk from potential attackers to break into the systems and steal the customer information. 3. Identity theft is a type of crime where someone uses your personal information without your permission to commit fraud or o ther crimes. 4. Malware attacks. Malware includes viruses and worms where their attacks can cause the damage on DOS, hardware and loss of data. 2. 2 Database Management System IntroductionA Database Management System is also known as DBMS is one of the software application used in Public Bank Berhad. A DBMS is best described as a collection of programs that manage the database structure and that control shared access to the data in the database It is a program that lets one or more computer users in the bank to create and access data from a same database. DBMS may use a variety of database models such as relational model or non-relational model. It also can be thought as a ââ¬Å"file managerâ⬠that manages data in databases rather than files in file systems.A DBMS provides facilities for controlling data access, enforcing data integrity and maintaining database security as well. Hardware and Software requirements For hardware requirement of DMBS, it needs a basic 32-bits or a 64-bits operating system in order to implement the software. The minimum CPU speed for a DBMS is 1GHz per server but it is recommended to apply a 2GHz, multi-core for each server. Minimum RAM requirement before implement DBMS is 512MB per server. However, for multiple databases which is more than 100GB,it is recommended to apply 4GB for each server. While in disk ubsystem, it must at least enable SCSI or SATA hard disks or SSD which provides minimum 7200 rpm. For a better or high speed database, a SDD or high-speed HDD arrays will be more suitable for the system. Functions and Core activities performed Generally, there are several functions of DBMS in Public Bank which is:1. Support Concurrent Updates -Concurrent updates occur when multiple users make updates to the database simultaneously. So it is important for Public Bankââ¬â¢s database management to ensures that updates are made correctly and the end result is accurate to avoid lost of data or inaccurate data stored. . Recove ry of data -In the event of catastrophe occurs, DBMS of Public Bank can provide ways to recover a database so that data is not permanently lost. If the database is destroyed or damaged in any way, DBMS will able to recover the correct state of database by making a regular backups of information. So in the event of a disaster occurs, the database can be restored to the state that it was last at prior to backup. 3. Able to update and retrieve data -This is a fundamental component of DBMS and essential to database management.Updating data in database includes adding new records, deleting existing records and changing information within a record. Advantages and Disadvantages There are several advantages of DBMS in Public Bank and the first will be storing lots of data in one place. By using DBMS, Public Bank can store a large amount of important and sometimes some confidential information such as pay records and personal details in a database. Besides that, security of data also a major issue where Public Bank will able to keep confidential information, passwords and restricted that data only available for certain high-level employees.Next is a fast query where employees of Public Bank can searched for data by just key in certain keywords and thus will enable all the relevant information to appear on the screen immediately. Lastly is ability to share by more than 2 users. With DBMS, employees of Public Bank will not faced network jammed because the database or the same data can be accessed by multiple users at the same time. While there are some disadvantages of DBMS too which is complexity and costs. The control and administration of DBMS are challenging and hiring administrators who are specialized database experts is also expensive.Secondly, confidentiality, privacy and security risk is another main issue because when information is accessed remotely, the possibilities of information disclosure and leakage are greater than with conventional data processing syst em. Last disadvantage of DBMS is data quality and data integrity risk where when databases are accessed and used by multiple users, it will increase the risks of potential damage to the data. Users who are not database experts may try to update or append data to the database will caused damage of data too. Implementation challengesPublic Bank Berhad should rent or lease the DBMS system from other vendors or outsourced it since managing or build a internal database is much more complex and it take a lot of costs. So they may hire other vendors especially some professional in managing database system in order to help them in the process. Then, the benefits of rent the database from other vendors is the company just need to pay for the amount they used or some maintenance fees. When there is some latest software published, they also may immediately change for it after their license for the system had expired. In addition, they also may just add on extra space for the storage of data by just pay for some extra costs. There are several issues faced when DBMS is implemented: 1. Primary VS Secondary memory -Before a DBMS is implemented, Public Bank should consider whether which memory they would like to use whether a primary memory or secondary memory for a more effective processing. Primary memory is fast and has a low latency but it is non-persistent and its size may be smaller than data size. Secondary memory is opposite in each case.2. Recovery The transaction in Public Bank may face failure or the system also could fail, so implementation of DBMS must be able to recover as much data as possible and it must never leave a transaction ââ¬Å"half doneâ⬠so it should restore all the data to consistent state. 3. Query processing -The DBMS must able to translate the query into relational algebra (RA) expressions because it likely to be more efficient and indirectly this will minimize the size of intermediate relations. It also must provide different algorithms for each RA operation. Then cost is estimated using statistical information from the database catalog and the cheapest queries should be chosen. Security Issues After DBMS is implemented in the company, it may face some threats to their database which caused loss of integrity, lost of availability and loss of confidentiality. To protect database against these types of threats, Public Bank may 4 methods to encounter the threats which the first one is access control where user accounts and passwords to control login process by DBMS is created.Next is inference control and it controlled the access to statistical database which is used to provide statistical information or summaries of values based on various criteria. The 3rd is flow control. Flow Control is a type of security way which prevents information from flowing in such a way to reaches unauthorized users. The last security method is encryption used to protect sensitive data that is being transmitted via some type of communication network. The data is encoded using encoding algorithm and only authorized users are given decoding or decrypting algorithm or keys to decipher the data. . 3 Enterprise Resourse Planning System Introduction Enterprise Resource Planning systems or ERP are software modules that handle the core functions of a business enterprise which integrates all department is the business including planning, human resource and finance and marketing. In Public Bank, ERP is used to integrate all networks from different department into a single central database for a better data transfer. Public Bank use ERP systems to maximize resources improve customer and vendor relationships and empower decision made. With the implementation of ERP system, the process of the bank will be faster and more effective. Hardware and Software requirements Hardware requirements to install a ERP is it must has a CPU which is running Intel Pentium III 500 MHz or above and minimum hard disk space needed is 30 GB. For RAM, it mu st at least has 256 MB but 512 MB RAM is recommended for a better performance. The PC must ensure it has a CDROM if the ERP system is installing from a CD and at least it has Intel Compatible Ethernet Card for the NIC. While for software requirements, the PC must has at least Windows NT Server 4. or Windows NT Server Pack 6. 0. Then,it needs a internet browser which is at least Internet Explorer 5. 0 or above.Besides that, it also need at least Microsoft SQL Server which is 7. 0 or above. Functions and Core activities performed There are several functions of ERP in Public Bank: 1. Central Database -A central database is essential for an efficient ERP system because it allow for visibility between operating divisions and help improve business processes in multiple departments. All departments in Public Bank may use the same input format so no time is waste in transferring and translating information. . Human Capital Management -ERP software allows Public Bank to manage their employee s more effectively or track their employeeââ¬â¢s progress. This means employees can be better awarded for good performance and employees with potential can be targeted for additional training. It also helps to ensure the goals of employees are in alignment with the goals of Public Bank. 3. Operations Management -The operations management provides managers with the capability to manage procurement and logistics, resulting in efficient flow of materials.Managers of Public Bank use this automated process in real time to control the product development and manufacturing life cycles. Indirectly, this will helps them to cut the costs. 4. Performance Measurement -It provides real-time measurements and metrics that assist managers in understanding the business and making decisions. Business monitors key performance indicators (KPIs) are used to measure against expected performance such as employee turnover rate. Using ERP, it can integrate this with other business process such as plannin g, forecasting and budgeting. Advantages and DisadvantagesThere are some advantages of ERP in Public Bank and the most important is integration. By using ERP, all the business departments can be integrating into a single and cohesive platform. In addition to synchronization of work flow, ERP also provide a clearer overview of enterprise functioning and quicker performance. Secondly, ERP help to reduced operation costs because the system facilitate faster information flow between departments and offices so it will help employees to work faster, save valuable time and reduce operational costs. Another advantage of using ERP is data benefits.ERP has ability to streamline data so it reduces redundancy of similar data from different departments. All data is linked to each other and stored in a database so the data will only updated with accurate information and the data from a central database is accessible to multiple departments so it increased information processing time and allowed m anagers to obtain critical information quicker with a better accuracy. Last advantages is aid strategic planning decisions. ERP systems allow Public Bank to access data in real time and due to this it allow them to become more nimble and align it process and operations with their organization goals. So they can quickly captured the situations and come out with a proper solutions to overcome it. Implementation Challenges For ERP system, Public Bank should just purchased or buy the system once they have confirmed or identified that the system chosen is totally meet their requirement. It is because if the company had purchased an effective ERP system for their company, they do not need to pay large amount of money for the new training of their staff or employees and the costs for the purchase of new system. If the company purchased the system, they will only need to pay a little amount of money for the maintenance of the system.Besides that, if the company choose to implement new ERP sy stem, it will take a long period for their employees to adopt with the new system . Indirectly, this will reduce the productivity of the employees and wasted the resources of the company. Several issues need to be concerned before implementation of ERP: 1. Resistance to change -Adoption with ERP system is a major issue before the system is implemented because many units or divisions in Public Bank may resist to ERP due to insufficient guidelines or explanations from top management. If the benefits of ERP are not explained well, the recipients may resist and slow down the successful adoption of the system or refuse to use it correctly. 2. Training -Usually ERP errors result from improper user training. Public Bank should consider provide adequate time to thoroughly train the users because if without a proper training, they might often find themselves struggling to get proper materials. 3. System selection -There are many types of ERP system from different vendors so Public Bank should choose ERP systems base on functionality, scope, price and ease of use of the ERP.If the company fail to address these issues during selection of ERP system, they may face multiple challenges before, during and after the system was purchased. Security Issues There are a lot of issues about the security in ERP systems which include theft, damage, copying, unauthorized access to information, natural disasters and sabotage. But most common forms of security threat to ERP systems are from computer technology which is tapping or hacking. Public Bank may used security controls where authorized user need to log in with a secure username and password he may use the system.Besides that, they can limit a userââ¬â¢s accessibility into a certain level only so employees are only able to find some data regarding to their departments. Then, data encryption also can be used where it limits someoneââ¬â¢s ability to export the database. Audit logs is build in ERP systems to track individual tr ansactions or changes in the system but it only provide a little detail about the relevance of the transaction. However, most of the organizations do not configure their ERP system to maintain audit logs because they are concerned about performance, degradation and they think they donââ¬â¢t need it. . 0 Porterââ¬â¢s Five Forces Analysis The Porterââ¬â¢s Five Forces illustrates how the competitive environment in the industry impacted by five forces. These forces are Threat of potential competitors, the intensity competition among existing firms, the power of suppliers, the power of the customers and the easiness of changing to substitute products. Porterââ¬â¢s five forces tool helps understand where power lies in business situation and it is useful, because helps understand clearly about the strength of current competitive position and the strength of a position that need considering to move into.Public Bank has used this porterââ¬â¢s competitive model to developed comp etitive strategies and enhanced performance by using information systems. Next, information systems that used by Public Bank are Customer Relationship Management System, Enterprise Resource Planning and Database Management System. 3. 1 The Power of Customers The power of customers is one of the forces of Porterââ¬â¢s Five Forces. Itââ¬â¢s refers to the ability of customers can exert on businesses to get them to provide higher quality products, better customer service, and lower prices. The power of customers is one of the forces that shape the competitive structure of an industry. For example, Public Bank is one of the banks that faced these forces. Customers switching their loans and investment from one commercial bank to another, because banking industry is provide service and customer does not require to pay any large amount of costs. So, when the number of suppliers of investment banking services increase, the bargaining power of customers also increased. Besides that, cust omer power become high also because substitutes are available, threat of backward integration is high and costs switching are low.Porterââ¬â¢s five forces can solve by using information system. Appendix 1) Information system that can solved bargaining power of customer is Customer Relationship Management System (CRM). CRM is a technology and best tool use to analysis customer desires and needs from the firm, it is also a database created for the different type of customer information which helps to have a competitive advantage with others firm. Based on staff opinion, CRM collected and stored customer information to information and business strategy use. Based on staff opinion, ERP help to shares the data flow from one department to another department across the organization. Besides that, ERP also manage the information flow from organization to the connection with outsiders. For example, customer may get their money from ATM from one bank to another or they get money from other bank use different debit card or credit card. ERP help manage all the money flow and transfer the data to the organization. In addition, ERP system deal with customers as well as other people, they attempt to cover all the basic operations of any given organization and government. Moreover, ERP is easier to use and enables organization get better understanding their business and standardize business process. ERP help organization to attract customer because they manage all information and data systematically and efficiently, this give a nice impression to customers. Database Management System (DBMS) is software system uses a standard method to cataloging, retrieving, and running queries on data.DBMS manages incoming data, organizes it and provides ways for the data to be modified or extracted by organization. Public Bank use this software system to manage large structure sets of persistent data, offering hoc query facilities to customers. DBMS help Public Bank manage their customer data and make staff easier to find the information when they needed. This saved a lot of time and cost to the organization and customers. Besides that, its gives a good impression to customer and make them more confidence to the organization and build a customer loyalty.DBMS also accept the requests for data from the application program and instructs the operating system to transfer the appropriate data. When DBMS used, information systems can be changed easily as the organization required to change. DBMS is design to help organization record the data into different types and related to each others. This makes transaction processing more efficiently and systematically. 3. 2 The Power of Suppliers A bank has three suppliers of its products; it is depositors, the credit market and the central bank.Suppliers is very important and powerful to an organization, in banking industry they provide bonds, and certificate to sell to the bank and bank will sell those things to customers. Without suppliers, organization canââ¬â¢t function well, when supplier less and they provide limit action to the industry then power of supplier will be high and powerful. Large clients, corporation, government agencies are offered packages of services in market orientation in management. The central bank is effectively resources of last resort, its supply liquidity banking system in virtually unlimited quantities at a reasonable cost.Information system can help bank to en hance their performance and run the process effectively. Public bank used CRM to maintain a good relationship with their potential suppliers. They understand anticipate and respond to the needs of an organization to help grow relationship. CRM ensuring the correct people in place, with the correct skills to deliver outstanding personal service and establishing clear material service that supplier need. Based on staff opinion, CRM help organization having a good relationship with supplier can make all things become easier.Staff can easily prove the document from supplier and also can pass the document to customer in short time. This saved cost and time because shorten transaction processing time. Besides CRM, ERP is also a important system to enhance relationship with suppliers. DBMS is important for organization to interacting with suppliers and customers. .3 Threat of New Entrants Threat of new entrants is a factor that leads to increase the number of competitors in an industry. New entrants is competitive because they having the same activities and business in same market. Normally when one industry making high profit will attract new entrants to compete, when new entrants keep increasing, itââ¬â¢s will causes some firm lose and they will exit in that industry. So, to keep the organization increase profit steadily, organization must have a unique characteristic to attract customers and also have a good relationship with customers. But in banking industry, probability threat of new entrants is less because want enter bank industry is not a easy way. They need a lot of board of director and required a lot of capital. Essay Example According to him, a government is not needed and should be regulated when a natural society is large enough as a moral virtue is unnecessary in governing man prone challenges. In comparison to my own ideas enlightenment living, Paineââ¬â¢s idea of government as unavoidable evil is out of place because; people need an authority and a point of reference. Governments and monarchies are rightly places because people need a leader in charge of decision-making, protect and preserve the community. The government represents its citizens in the entire nation and without it citizen would lack a single entity to stand for their feelings. The countryââ¬â¢s security is risked without the government that represents the voice of its people. Paine argues that monarchy is not grounded in liberty but prejudice, while peopleââ¬â¢s constitution is the real freedom form. He challenges people to see the underlying problems of the monarch irrespective of its enduring tradition that is unquestionable, (Paine, Cronauer & Recorded Books, 2005). Paine firmly disagrees with the monarchy and hereditary succession principle and he quotes the bible in many occasions that the basis of monarchy is strongly in opposition of the truth of bible. He terms the Kings government as outright idolatry, an kind of administration that did not emanate from nature or divinity but originated from Heathens that resulted from disorderly gangs and cruelly forced themselves in power against peopleââ¬â¢s will. He refers to as Englandââ¬â¢s Monarchy founder as French bastard because he believes that William the Conqueror forced his way to boastful rule against his peopleââ¬â¢s will, (Paine & University of Virginia, 1993). According to pain the hereditary leaderships of leaders is not a moral virtue guarantee because moral virtue cannot be inherited and future generations will be led by enthroned gracious kings. Viruses are living organisms Research Proposal Example | Topics and Well Written Essays - 750 words
Viruses are living organisms - Research Proposal Example Viruses are not as alive as bacteria because bacteria are proven to contain DNA which is missing in Viruses. However Viruses are not dead. They may lie dormant for certain period of time and then become active when they find a host. Thus we can say that viruses are very close to life and are only looking for a suitable host. Once the host is found, viruses can multiply rapidly just like bacteria. Mahy (1998) explains, "Outside a living cell, viruses are unable to multiply; they must enter a living cell - called the host cell - to reproduce. Thus, viruses exist at the threshold of life, and their multiplication is intricately bound up with cellular processes of the host. For this reason, antibiotics, which stop the multiplication of bacteria, cannot be used against viruses, since most substances that stop virus multiplication will also kill the host cells." As mentioned above, another important distinction lies in the presence or absence of DNA that distinguishes viruses from other living organisms like plants and bacteria. For an organism to qualify as living, it must contain both DNA and RNA. DNA is responsible for heredity while RNA aids in cellular functions. In most viruses, only RNA is found while DNA is missing. But interestingly scientists have found some viruses that contain DNA and no RNA. In other words, viruses are still not living organisms in the way bacteria are because to qualify as a living thing, they must have both RNA and DNA. Absence of either one can mean sub-life existence. Viruses are also different on account of the genes present in them. It must be argued that living organisms need a large number of genes to qualify as living things. Based on this presumption, we can say that even the smallest of bacteria are more alive than viruses. This is explained by Oldstone (2000) in these words: "Viruses have relatively few genes compared with other organisms. Measles virus, yellow fever virus, poliomyelitis virus, Lassa fever virus, Ebola virus, Hantavirus, as well as the human immunodeficiency virus (HIV), have fewer than ten genes each, whereas a smallpox virus may contain between 200 and 400 genes. These numbers compare with 5,000 to 10,000 genes for the smallest bacteria and approximately 80,000 to 100,000 genes for a human." (p. 9) These are the reasons why Viruses are neither called dead nor alive. They however qualify for a near-alive status because once they find a host; they can multiply with amazing rapidity and can suddenly become very active. In their dormant state however, they are nothing more than a speck of nucleic acid material. It must then be concluded that viruses cannot be called alive in the true sense of the word though they are almost-alive and act like parasites waiting for a suitable host. It must also be mentioned here that a living organism is one that is not dependent on other organism for its survival. Viruses meet this requirement to an extent because while they depend on a host for multiplication and activity, they do not exactly die when they are left alone. Instead they stay dormant till they find an organism to live upon. "Viruses never really die. If viruses are not actively reproducing, they can indefinitely maintain an inert state." (Goudsmit, p. 5) It would thus not be wrong to say that viruses maintain an almost-alive state but are not as living as bacteria or some other organisms capable of reproduction. They do not both DNA

Either women's rights or body image Research Paper
Either women's rights or body image - Research Paper Example 74)â⬠; some children seem to simply live with the television on, whether as entertainment or for background noise. The question that does exist is in regard to just how harmful all of this television viewing is to children and there are a few ways in which this question can be considered, all of which point to the damage that too much television can cause, and they are physically, mentally, and emotionally. Physically, it has been proven that too much television viewing is harmful to childrenââ¬â¢s eyesight, regardless of how close a child actually sits to the television screen (Comstock, pg. 38). Even though television has proven to not have lasting negative effects on the eyes, there are some implications that can cause temporary blindness or spots before the eyes, or longer lasting issues that need medical correction such as vision distortion or near or farsightedness. Most children tend to watch television in the dark, which causes the eyes to strain, which then often causes eye fatigue. This can be easily fixed by cutting down viewing times, by not watching television as often in the dark, and by sitting a safe distance away from the screen, but over time children can develop issues with their eyesight that might need fixing with glasses or else cause problems as they get older (Comstock, pg. 42). Another physical consequence of too much television viewing is the possibility of obesity. When children spend more time in front of the television, they are spending less time playing and getting exercise. Zimmerman et al (pg. 338) stated that ââ¬Å"eating is a common activity in front of the television; the more that a child watches television, the more they eat, and the more they risk developing obesityâ⬠. They do not spend enough time exercising and ridding themselves of the fat that they take in while they are watching television. The fat builds up, causing obesity. When children watch television, they become more concerned with their entertainment

Dialogue between Two Women Essay Example | Topics and Well Written Essays - 750 words
Dialogue between Two Women - Essay Example One major difference between the two centuries is the industrial revolution that changed the whole social dynamics of the world. Flora: But it has changed. Nowadays seeking a profession for a woman is not taboo. But most of the professions that women get areas housemaids or if they are good at reading and writing, they can be teachers or they can become novelists like me. Jane: Well, that sounds nice, even though your century seems more open, but still women are not equal to men in social dynamics. I donââ¬â¢t know about the specific roles in your society but here in the eighteenth century, we women, usually after the age of 23, wait for their prince charming to knock at their doorstep. We have to show shyness and have to act delicate, that attracts men and we can get married. Flora: I understand but here in my century, times have slightly changed. Many women professionals (mostly artists) are stepping up to the challenge. We donââ¬â¢t necessarily have to get married and think about children only. A woman who now seeks a career and lives life on their own terms are now looked upon by many women. You were born in the romantic era, where the romance was in full swing, the typical romance where the man takes the initiative and takes the lead. I am born in the Victorian era where women rulers are looked upon. Jane: Even though womenââ¬â¢s roles in your time are more liberal but I would cling to the modesty of my 18th century. There are no restrictions on women in choosing the profession and earning a living for themselves but the Victorian era makes them the ruler which is somewhat of an unknown territory. At times it does feel alluring but I have my reservations. Flora: I enjoy the liberty and choices my century has given me. We are more independent and are more involved in the social dynamics.

Methods of Navigation in SAP - Assignment Example It means that each order must be identified with a specific reference number that acts as an identification number for the transactions. It is different from a manual system in that the manual system such as SUA does not require the creation of reference alongside any sale order. Moreover, the manual system such as SUA does not rely on any specific order of making sales order. This format is beneficial to the company since it facilitates faster retrieval of information and reduces the time spent in searching for sales order in case of a high volume of transactions. In addition, the method helps link a sales order to various financial and administrative functions like customers and suppliers in the company (Cleveland 45). Henry James The Turn of the Screw Essay Example for Free
Henry James The Turn of the Screw Essay At first glance, it would appear that Henry James The Turn of the Screw and Tim Burtons Edward Scissorhands have only one thing in common: they are both from the gothic genre. But upon looking closer, one will notice that there are a number of other similar traits between the two. There are noticeable similarities between Edward and the Governess, as well as similarities between Edward and the two children in The Turn of the Screw, Miles and Flora. There are also general themes which the two share images of a perfect society, as well as onlookers who have no control over the situation. Both The Turn of the Screw and Edward Scissorhands have many traditional features of the gothic genre. However, when compared to each other, it is found that The Turn of the Screw has more of the traditional gothic elements. These include things such as the mysterious setting; an atmosphere of mystery and suspense that is present throughout the entire novel; visions, which are a regular occurrence for the Governess; supernatural events such as the ghosts and the possessions of the children; high emotion; women threatened by males, which is found on the many occasions in which the Governess feels threatened by Quint; and there are many instances in which the women of the novel are in distress. In spite of this, a number of these elements can also be found in Edward Scissorhands, if not to a lesser extent. These include elements such as the setting while the entire movie does not take place in a gothic setting, there are times where the viewer is able to see Edwards original home a mysterious, gloomy castle; an atmosphere of mystery and suspense, which is an underlying theme throughout the movie; visions to some extent experienced by the Boggs neighbour; and supernatural events largely, the overall creation of Edward. Other elements that are similar between the two are women in distress in Edward Scissorhands, this is largely Kim; and women threatened by males shown in scenes with Kim and her threatening boyfriend, Jim. There are not only similarities between the overall genre of The Turn of the Screw and Edward Scissorhands, but between the characters as well. There are striking similarities between the Governess, the narrator of the book, and Edward, the main character of the movie. One of the most prominent is thatà neither of these lead characters have much experience in the real world, as is evident through their actions and words. However, the Governess and Edward deal with this in different ways. Edward is generally dazed and confused about everything. Nevertheless, Edward is willing to learn, and is open to being taught. In contrast, the Governess reacts to her lack of experience by acting as though she is knowledgeable. She is unwilling to try other methods, and refuses to listen to others who might know better. Both characters were also taught the difference between right and wrong. Edward is taught this by the inventor, while the Governess is taught this through both her upbringing, and by her father. Both Edward and the Governess are taught this in theory, but have never experienced it in practice that is, they have never been able to apply the idea of right and wrong to the real world. Additionally, there are a number of similarities between Edward, and the two children, Miles and Flora. Both have overbearing female or mother figures in their lives. In Edwards case, this is his foster mother, Peg, who tends to be more caring towards him, and looks out for him. In the childrens case, this is the Governess. However, unlike Peg, the Governess coddles the children, spending all her time with them and not letting them out of her sight. Both of them are also blamed for something which they didnt do, or which never happened. Edward is framed for the robbery and murder, which had the potential to get him in trouble with the law. This was a deliberate blame and set up. On the other hand, Miles and Flora were accused of seeing ghosts, and lying about it. However, in contrast to Edwards situation, we never know whether this actually happened but either way, it wasnt a deliberate setup. There are even more similarities between Edward and the two children. Both of these characters are abandoned by their father figure. In Edwards case, this is in the death of his inventor. Because of this, Edward has to learn to cope for himself, and as a result, is confused about how to act correctly. This differs to Miles and Flora though their parents die, and their uncle effectively abandons him, they still have people who are willing to look after them, such as Mrs Grose and the Governess. They are also bothà idealised by the people around them. The community idealises Edward he is treated as a phase, the latest craze. They have preconceived notions of him, but dont take the time to get to know him and see if theyre actually true. In the childrens case, this is where the Governess idealises Miles and Flora. She imagines them to be so perfect and innocent, but she doesnt take the time to get to know them. Because of this, when they act differently to the behaviour she expects of them, she thinks something is wrong. Edward and Miles are both seen to have dangerous characters, and because of this they eventually become shunned or kicked out though the extent to which this happen differs. Miles is seen as a danger to the other children, and is kicked out of his school, but he is not rejected or shunned overall, just from one place. In contrast, Edward is eventually shunned by society as a whole because they dont understand him. As a result of this, he is rejected by society, and becomes an outcast. The narrative structure of the two texts is also quite similar. Both of them are told by a female, and in the first person. This viewpoint makes the story seem more personal, as it gives the reader or the viewer a better insight into what really took place. Both stories also start off in the present tense, with someone talking about the events which had previously taken place, before going into an account of the story. However, in The Turn of the Screw, we never go back to the original setting, whereas in Edward Scissorhands we are taken back to the original storyteller to finish the story. In both instances, it also gives the feel of the storyteller holding onto the secret, and waiting for the right time and place to finally tell their story to a willing audience. There are a number of general things which are common in both the texts. One of these is that both The Turn of the Screw and Edward Scissorhands have onlookers that have no control over the story, and dont fully understand what is going on. In Edward Scissorhands, the onlooker is Kim Pegs daughter who is a silent observer, and unsure as to what is happening. In The Turn of the Screw, this onlooker is Mrs Grose. Mrs Grose has no control over the actions of any of the other characters, and is forced to sit back and watch as the events take place around her, not fully knowing what isà going on. Another theme common in both texts, as well as being common in the gothic genre, is the idea of a woman being threatened by a powerful, impulsive, controlling male. In The Turn of the Screw, this is Quint, who, though dead, makes the Governess feel threatened. In Edward Scissorhands, the male is Jim Kims boyfriend. She feels threatened by his actions, and especially at his reaction to Edward. But the most obvious similarity between the two texts is that both have a perfect society, which slowly falls away, leaving the reader with an image of a very tainted place. In Edward Scissorhands, the community that he lives in is regarded as perfect, with everyone being accepting of him. However, as the story progresses, the perfect image falls away and we are left with a community that is biased and judgemental. In The Turn of the Screw, it first appears as though everything is perfect particularly the beauty of Bly, and the childrens characters, but we soon learn that it isnt. Overall, while there are some aspects of the texts which are entirely different, there are too many similarities for one to say that they are not alike in some way. These similarities are shown in a number of areas in the genre, the narrative structure, the characters actions and thoughts, as well as the overall themes and ideas which are introduced. However, whether The Turn of the Screw and Edward Scissorhands are similar or entirely different, they are both classic examples of the gothic genre of fiction.

The Relationship Between Entrepreneurship And Innovation Commerce Essay
The Relationship Between Entrepreneurship And Innovation Commerce Essay What is the relationship between entrepreneurship and innovation? Depending on which model you are looking at entrepreneurship has a differing relationship with innovation. There are definitions out there that make an entrepreneurial behaviour almost identical to that of innovation. Is there more to innovation than being entrepreneurial? Can entrepreneurship be defined by innovation? These are some questions I intend to answer throughout the essay and I will examine and determine how the two are related, however large or small the relationship is. Up to 1 in 3 business start-ups fail within the first three years and with the amount of start ups, 3 per minute in 2001, there is a lot of prospective, hopeful entrepreneurs aiming to succeed in business but fail. What is the difference in characteristics between those that succeed and fail, is there a clear differentiation and can the amount of innovation used by the entrepreneur effect the success of the business? I aim to come to a conc lusion and answer all of these questions throughout and critically analyse differing theories. Both of the terms are often used interchangeably with little understanding of the differentiation between the two (David Johnson, 2001). My interpretation of innovation is that it has a lot to do with the invention of a product or a process and is a change in the norm, which then becomes the norm. A good example which would show innovation would be the movement from the floppy disk to the CD ROM, this is a clear move with a totally different design and then became the norm, till further innovation happened and the USB flash drive has become the most common for file storing and transfer. The question of defining entrepreneurship and linking it to innovation is harder than it sounds. There are many studies of entrepreneurship however there is no specific definition as it cannot be summed up into one single statement. There are various models showing a differing correlation between innovation and entrepreneurship. I see the link between the two as one in which, if worked together in har mony there can be a prefect outcome in terms of the success of an entrepreneur. Not everyone who starts up a business is an entrepreneur; it is the one who makes the best outcome of any opportunity given throughout the life of a business that will be a successful entrepreneur. There are different characteristics and different circumstances surrounding each successful entrepreneurs story but each made it down their route to become successful. A good idea is nothing more than a tool in the hands of an entrepreneur.'(Jeffry Timmons 1977) This idea shows that innovation, or the idea is just one single aspect of the processes of the entrepreneur in the making of, and continuing the success of a business. Therefore this means there is a relationship visible but it cannot be said it is one that says that entrepreneurship is more than just an idea, or innovation but it is using that idea. Innovations are the composite of two worlds, namely, the technical, and the business; so when only a change in technology is involved, this is just an invention; but as soon as the business world is involved, it becomes an Innovation. (Schumpeter 1934). An entrepreneur is an individual who establishes and manages a business for the principle purposes of profit and growth. The entrepreneur is characterised principally by innovative behaviour and will employ strategic management practices in the business this explanation is very relevant to what I am trying to explain and the link with business shows how entrepreneurs in business can be innovative. (Carland et al, 1984). These are how innovation and entrepreneurship can be defined in 2 different models. They can both be linked into each other visibly due to the idea of business in innovation and the innovative behaviour. However they can also be criticised due to saying entrepreneurs are only in pursuit of profit but this would depend on the personality of the individual. The founder of Oxfam, Joe Mitty, was solely interested in making money for charity and was a volunteer. Schumpeters view of creative destruction (1934) refers to the entrepreneur introducing a new idea that takes over a market and links entrepreneurs to economic growth and development. This could be an idea of shifting production processes, reducing the size of the workforce to increase productivity or indeed the introduction of a new product. The reason the introduction of the new idea has such an effect is, because of the unpredictability of the introduction, meaning there is no chance to prepare and lessen the impact of the new idea. Therefore Schumpeters theory was very much in line and the link innovation has with the entrepreneur is clear and represented by the fact that this creative destruction often leads to the overhaul of a market and takes over the old idea. For example the DVD, taking over VHS, and now they do not sell VHS in HMV and most other leading electronic multi media stores. The view of Kirzner (1973) is that entrepreneurs are individuals that recognise opportunity and find gaps in the market and test the viability of new business by trial and error and feedback from the market. Therefore these two views are contrasting with Kirzners view of entrepreneurship related more markets and gaps within them, and the responsiveness of an individual to react and make the most of this opportunity, rather than seeing the opportunity for a new product or idea, rather than simply moulding or adapting what is there already to gain market share. After this an entrepreneur differentiates from just an opportunist introduction and realisation of the idea by carrying on the idea and turning it into a viable business. These two ideas give a different level of linkage with innovation, rather than the destruction of Schumpeters model which creates the market for the product, Kirzner believes it is about adapting the idea to fit into the market, so the innovation may be seen as more lapse and less extreme in Kirzners case. OECD (1998) states that: (they) accelerate the generation, dissemination and application of innovative ideas this sums up one particular idea of the relationship between the two; it implies that entrepreneurship is innovative however, innovation is not always entrepreneurial. Innovation may only be one aspect in the beginning, or perhaps innovation should happen throughout and be continued through the life of the business to attempt to keep ahead of competition. Innovation is not always a radical destruction of a current process or product and it can just be a small alteration to current product or process. E.G. Sir Stelios Haji-Ioannou, an entrepreneur and the founder of easy jet, took an idea and used his business mind and talents to create and exploit the market, however did not invent any new innovative product, or production process but he spotted an opportunity for a budget airline which opened air travel up to the masses, whom perhaps could not afford what was there before it. Schere (1982) sums up an entrepreneur by giving their characteristics, it states they have a tolerance for stress and uncertainty, a real life example here can be the entrepreneur I interviewed, John Russell, who had to support a family at the same time as remortgaging his house and set up a business. To get through the stress of this whilst setting up and pursuing a successful business would take a lot of tolerance and self belief. The tolerance of uncertainty could be linked to innovation, if it is a new process or product and it has not been tried and tested in a market as is discussed by Kirzner (1973), the entrepreneur is taking a big risk even if the gap in the market it there in theory, there is no certainty due to the irrational behaviour of consumers. Schere gives a characteristic of entrepreneurs that they are open minded and can react quickly to change. The nature of innovation is that however prepared or quickly entrepreneurs can react they are often powerless to prevent a total overhaul of a market, due to the action of another entrepreneur (Schumpeter 1934). Timmons et al (1985) gives one of the largest sets of traits in the field. The trait of having the drive to achieve and grow is one of them. The drive to grow is one trait of interest and can be linked in to what has already been discussed, due to the distinction between innovation and entrepreneurship, with innovation being the starting point of a process and the entrepreneurial side leading to the growth of the business, however innovation would be needed throughout the life of the business to lead to a growth in the idea, an example is Simon Cowell who from X factor went on to expand using entrepreneurial prowess to take it into other countries and then went on and created Britains got talent, which introduced a new idea and process to the TV industry. Simon Cowell, just one example can already counter the idea of Timmons et al, of they have Low need for status and power, as it is visible that this interests him. Theories giving traits of entrepreneurs, however, is a generalisation of all entrepreneurs and can be easily criticised as there are so many different types and individual entrepreneurs that cannot be segmented and categorised. The studies give traits of entrepreneurs and do not take into account the background. For example, one entrepreneur may be a university graduate, whilst another could be a middle aged worker who has found a way doing what their business is doing more efficiently. Therefore it is likely that the traits they portray are not all identical to each other. If all the traits an entrepreneur is said to portray in journals and articles are true then entrepreneurs would be close to perfectly efficient and functioning human beings. People can also be innovative but cannot make the step up to become entrepreneurial, the BBC television programme (2. The Age of Plenty, The Foods that make Billions 2010) it shows us the story of how business has turned grain into one of the biggest success stories of the modern food industry. In the beginning it was one of the Kellogg brothers who invented the product; however it was the other one of the brothers that took it forward as a business. The person who created the idea is the brother of the entrepreneur and he could be seen as innovative. His brother was the one who took the idea further, by increasing the product range and adding sugar to it where his brother chose not to. Therefore a differentiation is shown here between the two thought processes of simply just an inventor and then an entrepreneurial mind that has increased the size of the company, and its profits, significantly. Apple, in recent times, is a great example to use when referring to both entrepreneurial expertise and new innovative products. Before the IPod was launched on October 23rd 2001, there were there means of personal media players which people were satisfied with. However the idea of 1000 songs in your pocket came by surprise and nobody could have predicted it. People used portable CD players and walkmans without realising the potential and they were later deemed clunky and useless. However, The IPod has become a household name, and despite not being the first mp3 player they revolutionised the MP3 and now people call them IPods rather than mp3 players. Here the iPod can be seen to be in line with Schumpeters idea of creative destruction (1934) because it is an example of how a new introduction (of the iPod) effectively destroyed the ideas that came before it, e.g. people dont use walkman anymore, due to the intro of the iPod. The reason Apple is a near perfect example of a complementar y relationship between both innovation and entrepreneurship is because of their actions after the initial introduction, and the way in which they continued to use innovative strategies and keep up the level of innovation and did not settle on the idea. Further developments on the IPod were brought to the market, for example the mini, shuffle, nano and the touch were all further innovations, and then they continued to create other products under the Apple brand. They made the new Mac books, the air and the pro, Apple Macs which further competed with other computer companies than they did in the past. Then more recently they have made the I Phone, which has 4 different models, and potentially more, iPad and in the future they are also looking into moving into a new (for them) form of media, TV. These innovative ideas, along with the fact that they are becoming a market leader in electronics and making huge profits year on year, whilst banging nails into past leader of the portable med ia industry (with the walkman) Sonys coffin (Naughton, 2010). They demonstrate perfectly why innovation has such a relationship with entrepreneurship. The reality of it is, however, one day there will be innovation, not by apple, and perhaps not by any of the current firms in the electronics market, that will kill off apple and lead to a new market leader. Due to the nature of innovation, however much Apple prepare they will not be able to prevent this happening. Druckers source of opportunity (1985) is a model in which the opportunities for an entrepreneur come about both internally and externally. Internally through inadequacy, changes in market or coming about through chance; or externally through perception and mood, demographic changes and new knowledge, from individuals or chance revelations. Small firms are more innovative than their large firm counterparts, being less bound by convention and more flexible (Carter Jones-Evans 2006) This suggests that in large firms which have set policy and running to it, would be more ridged, and therefore less reactive to a change in the market and could be pushed out of the market due to new innovative firms taking over. Therefore for a business to succeed in the long term they may need innovative ideas to survive and prevent being overtaken by the more innovative smaller firms. To sum up the relationship between innovation and entrepreneurship is not a simple thing to do with a single sentence answer. What I can conclude is that there is a differing relationship between the two in different fields of study. A common idea of the relationship is that it is a dependant one, in which both are needed in an economy to stimulate economic growth. The idea that innovation is a part of the entrepreneurial process is one that I agree with, there can be innovation without an entrepreneur involved; however there cannot be a successful entrepreneurial venture without the input of innovation. This is because innovation is what will be the distinction between ideas, without innovation there may be change or progression and this could lead to a stagnant economy. The examples I have given of entrepreneurs are ones that I believe show a differing amount of innovation, but similar amounts of success, Stelios had merely a change in the pricing and strategy of airline firms whic h when compared to the example of apple is only a small change, however, innovation is still shown and is still important. Overall in most cases it is not just an individual entrepreneur people may be inspired by an individual innovative idea and create entrepreneurial flow of a business over time as a team which can lead to great success with the right mix of both innovation and entrepreneurial processes.
Community Service As Punishment Under The Ipc Criminology Essay
Community Service As Punishment Under The Ipc Criminology Essay Community service constitute an apologetic reparation that the person is now required to make to the community what he has wronged. The Indian Penal Code was the enacted in 1860 by virtue of the classic legal draftsmanship of Lord Macaulay. If there would have been a concept of community service prevalent at that time then the authors are sure that there would have been no need to urge the inclusion of the same in the Indian Penal Code. But since this exclusion by Macaulay is because of no fault of his it is our duty to incorporate such to meet the demands of the time and to make the IPC a living social document. Section 53 of the IPCà [2]à provides for the various types of punishments. But these are old and do not meet the exigencies of the present day globalised world. The authors yearn for inclusion of community service as a mode of punishment. Indian draftsmen have not overlooked the necessity of such a restorative mode in recent enactments. We find the inclusion of community service in The Juvenile Justice (Care and Protection of Children) Act, 2000à [3]à (Section 15à [4]à ). Community service is defined as an order that requires an offender (who must consent and be aged at least 16) to perform unpaid work for between 40 and 240 hours under the supervision of a probation officer. Formerly known as aà Community Service Order. It can also be defined as Aà communityà orderà which requires theà offenderà to do unpaid work in the community under the supervision of aà probation officer.à [5]à Moreover the work that the offender is required to undertake has some obvious relation to the nature of offence.à [6]à History of community service The first organized community service program meant systematically to be used in place of short prison sentences were established in ad-hoc basis in California in the 1960s. . Thus community service was indirect alternative to imprisonment.à [7]à In the United Kingdom, Parliament enacted legislation in the early 1970s giving the courts specific powers to order community service as a sentencing sanction.à [8]à In the early 1980s after a series of private pilot projects the Dutch implemented community service nationwide and evaluators made comparable findings.à [9]à It was Leninà [10]à who also stressed on the importance of community service.à [11]à Benefits of Community Service Community service serves the goals of punishment, reparation, restitution and even rehabilitation. It is beneficial to the offendersà [12]à , the communityà [13]à , the victimà [14]à and even to the courts.à [15]à So community service has both the social and the cognitive benefits. It also serves as an alternative to imprisonment (India has 32 prisoners per 1000 of population. We have 11094.25 lakhs prisoners in India as on 31 December 2005)à [16]à which is morally reprehensible and indefensibleà [17]à . Moreover Prisons have proved ineffective in their object of reforming the criminals. Research indicates that about half of all prison inmates are likely to be rearrested and returned to prison, many soon after their release from an institution.à [18]à Contamination is the gist of prison life. Prisons are dens of criminality. The unsophisticated offender is compelled to associate with the hardened professional criminals and thereby he learns not only the te chniques of committing the crime but also the specific drives, rationalisation and attitudes of crime.à [19]à The Community Service Program is intended to add some refinement by requiring the offender to put back into society through performing a job for the community.à [20]à Not only do offenders need to be addressed as active participants rather than as passive recipient of punishment or treatment, but they also need to be positively motivated to engage in the process of change to law-abiding lives. Performing work for the community, as well as requiring offenders to pay back to the society helped them realize that they had contribution to make to the society.à [21]à Developments in India Macaulay may have not envisaged the need of community service as it was not prevalent at that time. But it first dawned upon India in the 42nd reportà [22]à of the Law Commission.à [23]à Then an Amendment billà [24]à was introduced in the Parliamentà [25]à which was passed in the Rajya Sabha but due to the proclamation of emergency it could not be passed in the Lok Sabha and it lapsed. Again the Law Commission in its 156th reportà [26]à urged the need to implement community service in Indian Penal system.à [27]à Even the Malimath Committee and othersà [28]à recommended community service as mode of punishment.à [29]à Community Service Scheme has also been started in one state i.e. Gujarat and it is an alternate for offences under the Bombay Prohibition Act. Another state i.e. Andhra Pradesh (Prison is a state subject)à [30]à has also amended the Penal Code and introduced Community Service as a punishment. This legislation is now pending with the Union Government for their concurrence.à [31]à Cases and pronouncements We have instances where the court has ordered the offender to do community service in lieu of the offence that he has committed. The Delhi High Court asked two businessmen to perform community service with a voluntary organisation for a year as punishment for firing three shots at their friend for fun. Justice Sanjay Kishan Kaul, while quashing a first information report (FIR) against the two businessmen Monday, asked Delhi Police not to return their gun for a year.à [32]à For sexually harassing a woman on the bus the magistrate asked the offender to write a 25-page essay on eve-teasing and harassment. He was asked to make 500 copies of the essay and distribute them outside schools and colleges.à [33]à In probably a first, the Patna High Court has given provisional bail to two accused in a mobile phone loot case on the condition that they would have to do community service at a local temple thrice a week for six months.à [34]à The Indian Supreme Court though not having argued (even in their obiters) to have community service as a mode of punishment has nevertheless hinted at the importance and need for such type of restorative sanction. in one of the case the court said- A few other weighty factors deserve reference. All deprivation of liberty is validated by social defense and individual correction along an anti-criminal direction, public justice is central to the whole scheme of bail law. Fleeing justice must be forbidden but punitive harshness should be minimized. Restorative devices to redeem the man, even through community service, meditative drill, study classes or other resources should be innovated.à [35]à The unacceptable anomaly Community service was not incorporated in the IPC. The reason fascinates and confuses me. The neo democratic style of non-inclusion is too hard to swallow. The Law Commission of India circulated a letter highlighting the main issues involved in the Penal Code for eliciting views from various quarters.à [36]à The letter was sent to Registrars of High Courts, the Home Secretary of the State Governments Union Territories, the President of Supreme Court Bar Association and High Courts Bar Association, National Commission for Human Rights, National Commission for Minorities, National Commission for SC ST, National Womens Commission, State Law Commissions, Police Officers, Advocates, Academicians and some social organisations, Institutions etc. Responses were received from three State Governments, Seven Judges and one Additional Registrar of High Courts, Two Advocates, Six Police Officers, One State Law Commission, One Academician and Two organisations (Nirantar and Federation Indian Chambers of Commerce and Industry).à [37]à Now the recommendation that came out was that the proposed section 74 should not and cannot be implemented in India. The report laid- This section contemplates a supervisory authority to see whether the convict is working and rendering service for the number of hours specified and if he fails to do so by way of default, he has to be sentenced thereafter. We think an open air prison system is better suited from the point of view of the correctional measures rather than the proposed punishment of community service. The community service no doubt is another innovation in the direction of correctional methods but as voiced in many workshops it may not be practicable to give an effect to and also may not amount to punishment. The most horrifying aspect of the entire thing is that merely on the views of some of the judges, advocated, academicians, police officers and organizations an innovative and pulsating need of the criminal justice system was not implemented. The authors are unable to find a rational nexus with the reasons given for such non inclusion. Reforms Suggested What the authors want is that is not the inclusion of community service as a form of punishment but the authors want the successful and effective implementation of community service as a form of punishment under the code prepared by the legal acumen of Macaulay. That is the reason we do not recommend to amend the IPC and include community service as a sixth form of punishment immediately as was once tried by the 1976 bill.à [38]à It would not be an inclusion as we nowadays find the Indian legislators just amend and insert new provisionsà [39]à in the enactments without looking at its suitability and implemantability.à [40]à The authors suggest an area approach (AA) in the inclusion of community service as a mode of punishment. Firstly few selected areas must be selected which have the resources and concentration of specific crimes occurring in specific areas. Firstly, the Union must select few states and urge them to implement community service programs in few select areas. These areas must be selected by the state themselves with the concurrence of the Union. The areas should be selected on the basis of criterias such as prevalence of petty offences, resources availableà [41]à etc as decided by the state governments. The authors only intend to suggest that first implementation issues must be dealt with as per the acumen and foresight of the legislature and the executive. Then only we can dream of such a form of sanction. This was one precise lacuna in the 1976 Amendment bill. Beside this lacuna the authors find no other major loophole and feel that the proposed amendment was to a very large extent acceptable. But we suggest that in all the cases where the judge convicts the accused and imposes fine as the only punishment community service should be made compulsory. The other recommendations are as follows- It is recommended that in order to address such problem and increase efficiency, special community service officers be appointed and trained to handle offenders on community service. A lot of publicity should be given to this schemes initiation so that even the grass roots and the have-nots of the society are aware of such a change. The spread of the scheme must not be confined to the legal fraternity and experts. It must not remain a burning topic for the scholars and the academicians to debate and write scholarly articles and researches. The modes of publicity as newspapers, media and the government. The entire implementation and the process and the procedure of the community service scheme must be available in almost all the recognized languages of India so that the local masses are aware of it. It must be simple and clearly worded. The cooperation of various stakeholders such as the civil servants, the judiciary, the policy-makers and all other relevant stakeholders within the criminal justice system is vital for the process of implementation of the programme as well as for its ongoing sustainability. The implementation of such programme should be seen as the responsibility of every Indian, and endeavor should be made to help it succeed as a new intervention to replace imprisonment. ABSTRACT The Indian Penal Code was the enacted in 1860 by virtue of the classic legal draftsmanship of Lord Macaulay. The research paper tries to incorporate the needs and the benefits of community service in India. It would then delve upon the legal development of inclusion of community service as mode of punishment. It would be done by scrutinizing the reports of the law commissions, judicial pronouncements and the lapsed bills which urged such a reform. Then authors would suggest concluding the problems in the inclusion and implementation of community service in India and how to overcome these difficulties so that IPC meets the social needs and critics find one issue sorted in criticizing the IPC and its efficacy.
